1. Summary of Services

Crowdtilt Open is a professional and customizable reward-based crowdfunding and e-commerce software and communication service (the “Service”). The Service is hosted by Crowdtilt Open, but may be accessed at one of our customer’s domain addresses.

Crowdtilt Open is a website and service of Crowdtilt, Inc. or its subsidiaries (“Crowdtilt,” “Crowdtilt Open,”” “we,” “ours” or “us.”) Please read this Privacy Policy (the “Privacy Policy”) and make sure you understand it.

This Privacy Policy describes how Crowdtilt Open collects, uses, stores, shares and protects your information in connection with the Service, whether accessible via Crowdtilt Open’s domain name or one of our customer’s own domain names, co-branded websites (including sub-domains, international versions, and application versions) or our other services, applications, widgets and content provided through or in connection with the Service (collectively, the “Services”).

2. Application of Privacy Policy

This Privacy Policy applies when you access, visit or use the Service or a website using the Service and is part of, and is governed by, the terms and conditions set forth in the Crowdtilt Open Terms of Use and Checkout Terms.

By creating a Crowdtilt Open account, or by otherwise accessing, visiting, using, or transacting through the Service, you expressly consent to our collection, use, disclosure and retention of your information as described in this Privacy Policy and in the Crowdtilt Open’s Terms of Use and Checkout Terms, which ever is applicable.

We encourage you to keep the email address you provide to us current, and to promptly notify us of any changes to your email address, so that you may receive any notices we send to you regarding material changes to this Privacy Policy. If you do not agree to the new Privacy Policy, you may terminate your account within the applicable 30 calendar day period by contacting us or by deleting your account through the account settings link on your profile page, and you will not be bound by the amendments. Otherwise, the new Privacy Policy will take effect after 30 calendar days.

Crowdtilt Open is built on top of our public API. Our Public API was audited by a third party and met the most stringent credit card security standards: PCI Compliance Level 1.

Crowdtilt Open takes reasonable measures to protect the information you provide to Crowdtilt Open or submit through the Service against loss, theft and unauthorized use, disclosure, or modification. However, we cannot guarantee or warrant the security of any information you transmit to Crowdtilt Open or submit through the Service and you do so at your own risk. No internet or email transmission is ever fully secure or error-free. Email sent to or through the Service may not be secure. You should use caution whenever submitting information online and take special care in deciding what information you send to us via email. Say to yourself, “Would I want the NSA to see this?””

We encourage you to investigate and ask questions before accessing third party websites or disclosing information to third parties.

9. No Children under 13

Crowdtilt Open is not intended for use by children under the age of 13. We will never knowingly collect information directly from children under the age of 13 without verifiable parental consent. If you are under the age of 13, please do not provide us with information of any kind whatsoever. If we become aware that a user is under the age of thirteen 13, we will remove his or her information from our files. If you have reason to believe that we may have accidentally received personal information from a child under age 13, please contact us immediately at [email protected].

10. Information Processed in the United States

The Service is intended for users located in the United States. If you are located outside of the United States and choose to use the Service or provide your information to us, your information will be transferred, processed and stored in the United States. U.S. privacy laws may not be as protective as those in your jurisdiction. Your agreement to the terms of this Privacy Policy followed by your submission of information in connection with the Service represents your agreement to this practice. If you do not want your information transferred to or processed or stored in the United States, you should not use the Service. Use of the Service by users outside of the United States is not authorized by Crowdtilt Open and is at your own risk.

11. Retention of Your Information

We retain information for active Crowdtilt Open accounts as long as it is necessary and relevant for our operations. In addition, we may retain information from closed accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce the Crowdtilt Open Terms of Use and take other actions permitted by law. The information we retain about you will be handled in accordance with this Privacy Policy and our Terms of Use and Checkout Terms.

Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties’ direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year.
